Policy for Users of the Technogenetics SpA website.

The processing of personal data carried out by means of the website https://www.technogenetics.it or requesting the services available therein, e.g. by means of contact forms ("Forms" or "Module"), is carried out in compliance with the applicable legislation on the protection of personal data (Regulation (EU) 2016/679 - hereinafter "GDPR").

Data Controller and DPO

The Data Controller is Technogenetics SpA, with registered office in Via Privata Cesare Battisti, n.1, 20122, Milan, Italy (hereinafter the "Data Controller", the "Company" or "we").

The data we process

With your consent, we process the following personal data, which you provide when:

  • you browse the Site (without using any services);
  • you interact with the Site and use the available services and features, including: forms, newsletter registration, etc.; 
  • you send us e-mail messages.

This data includes, in particular, your first name, last name, contact details, professional qualifications, information submitted through the various form fields, as well as the specific content of your requests or messages. The data may also include additional data that the Data Controller may acquire, including from third parties, in the course of its business ("Data").

To enable us to fulfill your requests, you must provide the data marked with an asterisk (*). Without that mandatory data, we cannot proceed further. The information requested in the fields not marked with an asterisk, on the other hand, is optional: failure to provide it will have no consequences.

In any case, even without your prior consent, the Data Controller may process your data to comply with legal obligations, regulations and EU legislation, to exercise rights in court, to pursue its legitimate interests and in all cases provided for in Articles 6 and 9 of the GDPR, where applicable.

The processing will take place both electronically and manually and always involves the adoption of the security measures provided for by current legislation.

Purpose of processing

Data are processed for the following purposes:

  • handle your requests for information about our products and services and newsletter subscriptions. The legal basis for processing in these cases is your consent, which you express by sending the message/form or subscription request (art. 6.1.a GDPR) - please note that our newsletters contain a "pixel tag", see below, point c);
  • carrying out additional promotional activities about products/services we think you may be interested in. This includes contacting you face-to-face, providing you with promotional communications, materials and/or commercial information related to the Company's products and services, by traditional means (e.g.: paper mail, telephone operator calls, etc.). The legal basis for the processing is the legitimate interest of the Company (Art. 6.1.f of the GDPR). Please note that you can object to the processing of your data for this purpose by contacting us at dpo@technogenetics.it
  • to carry out further promotional activities through automated means (for example: e-mail). Please note that our promotional e-mails and newsletters may contain "Pixel Tags," which provide information about whether and when you open, delete, and trash our messages, and also the IP address or e-mail client used to view them; if the e-mails we have sent contain links to any online content, the Pixel Tags also transmit information to us about which links you have clicked on: to prevent this from happening, please check the settings of your browser, e-mail client, or e-mail account and block the automatic loading of images. The legal basis for processing for this purpose is the Company's legitimate interest in promoting its products and services and verifying the effectiveness of its campaigns, according to Article 6.1.a of the GDPR. Please note that it is possible to prevent the activation of pixel tags by operating browser or e-mail client options.
  • handle job applications and inquiries related to professional job offers; the legal basis for this purpose is your consent (Art. 6.1.a and 9.2.a GDPR);

Personal data are entered into the Company's computer system in full compliance with data protection regulations, including security and confidentiality profiles, and in accordance with the principles of fairness, lawfulness and transparency in processing.

Data will be kept for the time strictly necessary to achieve the purposes for which they were collected. In any case, the criterion used to determine this period is based on compliance with the terms of the law and the principles of data minimization and limitation of storage.

 

Browsing data

If you only visit the Site (i.e., without sending communications or using any of the available services/functions), the processing of your data is limited to browsing data, i.e., data whose transmission to the Site is necessary for the operation of the computers that run the website and Internet communication protocols.

This category includes, for example, the IP addresses or domains of the computers used to visit the Site and other parameters related to the operating system used to connect to the Site. The Company collects these and other data (such as, for example, the number of visits and the time spent on the Site) for statistical purposes only and in an anonymous form in order to monitor the operation of the Site and improve its performance.

Such data are not collected to be associated with other information relating to, or identifying users; however, such information, by its very nature, could, through processing and association with data held by third parties, allow the Company to identify users. Browsing data are normally deleted following anonymous processing but may be retained and used by the Company for the investigation and identification of the perpetrators of any computer crimes against the Site or use of the Site. Notwithstanding this possibility and the provisions of the Cookie Policy the browsing data described above are retained only temporarily, in compliance with the law.

Recipients of the Data

Data are processed electronically and manually according to methods and logics related to the purposes stated above and are accessible to the Owner's personnel authorized to process Personal Data and its managers, and in particular to personnel belonging to the following categories: technical, IT and administrative personnel, marketing and field personnel, compliance personnel, as well as other individuals who need to process the data to perform their job duties.

Data may be communicated, including to countries outside the European Union ("Third Countries") to: (i) institutions, authorities, public bodies for their institutional purposes; (ii) professionals, independent consultants, also individually or in partnerships and other third parties and suppliers who provide the Data Controller with commercial, professional or technical services necessary for the operation of the Site (e.g. provision of IT and Cloud Computing services), in order to pursue the purposes specified above and support the Company in the provision of the services you have requested; (iii) third parties in the event of mergers, acquisitions, transfers of business -or branches thereof- audits or other extraordinary transactions; (iv) corporate supervisory bodies, based at the Controller, in the performance of their activities (control over the application of legal obligations, ethical standards, etc.).

The aforementioned recipients will only receive the Data necessary for their respective functions and undertake to process such Data exclusively for the purposes indicated above and in compliance with applicable data protection regulations. The Data may also be communicated to other legitimate recipients from time to time identified by applicable legislation. Without prejudice to the foregoing, the Data will not be disclosed to third parties, whether natural or legal persons, who do not perform any function of a commercial, professional or technical nature for the Data Controller and will not be subject to dissemination. The recipients of the Data will process them, as the case may be, in their capacity as Data Controller, Data Processor or person authorized to process personal data, for the purposes indicated above and in compliance with the legislation on the protection of personal data.

In relation to any transfers of Data outside the EU, including to countries whose laws do not guarantee to the confidentiality of personal data a level of protection equal to that provided by EU law, the Data Controller informs that the transfer will still take place in the manner permitted by the GDPR, such as, for example, on the basis of user consent, on the basis of Standard Contractual Clauses approved by the European Commission, selecting entities registered in international programs for the free movement of data or operating in countries considered safe by the European Commission.

Your rights

By contacting the Controller at the above address, you may, at any time, exercise your rights under Art. 15-22 of the GDPR such as, for example, obtaining an updated list of the entities that can access your data, obtaining confirmation as to whether or not we process your personal data, verifying their content, origin, correctness, location (including with reference to any Third Countries), requesting a copy of your data, requesting their rectification and, in the cases provided for by the GDPR, request to restrict their processing, their deletion, object to direct contact activities (including limited to certain means of communication), including Newsletters and promotional material (direct marketing) by the Company or withdraw consent to their processing (although this does not affect the lawfulness of the processing carried out before the withdrawal of consent). Likewise, you can always comment on the processing of your personal data that you feel is inappropriate by sending a message to our DPO (dpo@technogenetics.it) or file a complaint with the Data Protection Authority.
